Excerpt: ...be against her, the true question was not what an elaborate investigation by experts might show to be the physical relation of the two streams, but what was meant by those who used the description; and for this purpose she resorted to evidence of knowledge and reputation. Evidence was given to show that the northern stream was consistently known as the Murray, while the southern stream was spoken of by various names, as Murrabit, Murrabeet, Murrabout and others. According to New South Wales of course the evidence of names was unimportant; if the stream appeared actually to be part of the course of the Murray and not of the Loddon, the difference of name could not make it another river. The political history was as follows: the island was first settled in 1845 under licence from the Commissioner for Crown Lands of the Port Phillip district; and after the separation of that district from New South Wales and its erection into the colony of Victoria in 1850, the settlers paid rent to Victoria until 18 59. By that time the land oflicials in New South Wales had begun to take notice of what they regarded as a change in territorial rights effected by the Act of 1855 already referred to, and a claim was made by New South Wales on the settlers for the rents. This claim was not contested, and the settlers thereafter paid rent to New South Wales and declined to make further payments to Victoria until she should make good her title. Victoria threatened a forfeiture, and the settlers resumed their payments. Thereafter they seem to have paid rent to both colonies. In 1 842 a representative element was introduced into the legislature of New South Wales, and Pental Island was uniformly treated as part of the Port Phillip district for electoral purposes....
